Below, you will find a comprehensive list of our Terms and Conditions, designed to ensure transparency, security, and clarity for all parties involved. Please take the time to read and understand these terms before proceeding with your purchase.
Ownership and Legal Compliance
- Clear Title and Legal Compliance: All plots offered for sale by Tarukii Developers are free from any legal disputes, encumbrances, or third-party claims. We ensure that the title of the plot is clear and unambiguous, ensuring a hassle-free transfer of ownership.
- Ownership Documents: Once the full payment has been made, and the plot registration is completed, buyers will receive the official title deed and other necessary ownership documents, which will establish their rights over the plot.
- Legal Formalities: Tarukii Developers will assist in the transfer of ownership and ensure all legal formalities are met. However, the buyer is responsible for all charges related to stamp duty, registration fees, and other official charges as per local government regulations.
Booking Process
- Reservation of Plot: A non-refundable token amount is required to reserve a plot. The token is adjusted against the total sale price. This payment secures your plot and prevents it from being sold to another buyer.
- Validity of Booking: After the payment of the token amount, the plot is reserved for the buyer. However, no further bookings for the same plot will be entertained, and it will not be available for sale to other buyers.
- Cancellation of Booking: If the buyer decides to cancel the booking, the token amount is non-refundable, as it is a commitment fee to reserve the plot.
Payment Terms
- Payment Schedule: Buyers can opt for one of the following payment plans:
- Full Payment Upfront: The buyer may pay the total amount in one go. In this case, the buyer may be eligible for special discounts on the plot price, if applicable.
- Installment Plan: The buyer may choose to pay the amount in installments over an agreed period. Specific details, including the number of installments, the due dates, and the final date for complete payment, will be provided at the time of booking.
- Payment Methods: Payments can be made via bank transfers, cheques, or other authorized online payment methods.
- Late Payment Charges:
- If payments are not received by the agreed deadlines, a late payment fee will be levied at a rate of X% per month, calculated from the due date until the payment is made.
- Delays in payment beyond a certain period (as outlined in the installment agreement) may result in the cancellation of booking and may lead to forfeiture of the token amount.
Registration and Documentation
- Government Charges: The buyer is responsible for all charges related to stamp duty, registration fees, and documentation as required by law. These charges will be additional to the sale price and must be paid before the plot registration.
- Plot Registration: The official registration of the plot will only occur once the full payment is received. At this point, the plot ownership will be transferred to the buyer, and the title deed will be issued.
- Timeline for Registration: Registration will be completed within 30-45 days from the receipt of full payment. In case of any unforeseen delays, Tarukii Developers will inform the buyer accordingly.
Plot Allocation and Layout
- First-Come, First-Served Basis: Plots are allocated to buyers on a first-come, first-served basis, depending on the availability of plots within the development.
- Plot Dimensions and Location: The exact dimensions, location, and facing of each plot will be based on the approved master layout. Tarukii Developers will ensure that all plots conform to the community’s planning standards.
- Plot Modifications: If there are any necessary changes or modifications to the plot layout, the buyer will be notified in advance. Any alterations will not affect the overall plot area and will be discussed thoroughly before implementation.
Development and Possession
- Infrastructure Development: Before possession, the developer will complete the essential infrastructure, including internal roads, street lighting, water supply, drainage systems, and fencing.
- Possession of Plot: Possession of the plot will be granted to the buyer once all the infrastructure is completed, and full payment has been made.
- Timeline for Possession: The timeline for possession will be shared with the buyer at the time of booking, and any changes to the timeline will be communicated in advance.
- Completion Delays: In case of construction delays beyond the stipulated timeline, the developer will inform the buyer and provide a revised date for possession.
Construction Guidelines
- Approved Construction Plans: The buyer must adhere to approved construction guidelines provided by Tarukii Developers. The plot can only be constructed upon after obtaining the necessary building permits from the local authorities.
- Compliance with Local Laws: The construction must conform to local building regulations, zoning laws, and any other applicable legal requirements.
- Non-Compliant Construction: Any unauthorized or non-compliant construction will be subject to fines, and the developer reserves the right to take legal action to remove such structures.
- Timely Construction: Buyers are encouraged to begin construction within a reasonable time frame (as defined by the developer), ensuring that the development’s aesthetic and community standards are maintained.
Transfer and Resale
- Ownership Transfer: Once the plot is fully paid for and registered, the buyer can transfer ownership of the plot to another party.
- Transfer Fee: A nominal transfer fee may be applicable when reselling or transferring the plot. The buyer will need to follow the prescribed transfer process to ensure the transaction is legally valid.
- Resale Restrictions: The resale or transfer of ownership is only permissible after the plot is registered in the buyer’s name and all payments have been completed.
Cancellation and Refund Policy
- Cancellation Process: To cancel a booking, the buyer must submit a written request to Tarukii Developers.
- Refund Terms:
- If the booking is canceled before registration, a refund will be processed after deducting administrative charges and the non-refundable token amount.
- Post-registration cancellations are non-refundable.
- Refund Processing: All refunds will be processed within 30-45 working days from the approval of cancellation. The refund will be issued through the same payment method used for the original transaction.
Maintenance and Society Charges
- Maintenance Fee: After possession, the buyer will be required to pay maintenance charges for the upkeep of common areas, including parks, streetlights, drainage, and other shared facilities.
- Charges Schedule: Maintenance charges will be communicated at the time of possession and are typically collected on a quarterly/annual basis.
- Non-Payment of Fees: Non-payment of maintenance fees will result in restricted access to community amenities and could lead to penalties or legal actions as per the society’s rules.
Dispute Resolution
- Initial Resolution: Any disputes that arise related to the sale or ownership of the plot will initially be addressed through mutual discussions between the buyer and Tarukii Developers.
- Arbitration: If the dispute is not resolved through discussions, both parties agree to resolve the matter through arbitration, in accordance with Indian Arbitration Laws.
- Jurisdiction: Any legal matters or disputes will fall under the jurisdiction of Ranchi courts.
